(Washington, D.C.) — Today, in response to two U.S. Court of Appeals' rulings on the legality of ObamaCare subsidies, Independent Women's Voice Health Policy Director Hadley Heath Manning released the following statement:
"Independent Women's Voice applauds today's ruling the U.S. Court of Appeals for the D.C. Circuit in Halbig v. Burwell. This is a victory for the rule of law, and for those who believe the President has no legal authority to unilaterally dictate what the law says and how he may implement it.
"By declaring the subsidies in question illegal, the second-highest court in the land has also simultaneously struck down the individual mandate and employer mandate regimes in the 36 states that chose not to create their own exchanges. And by striking down those mandates, the Court has now freed citizens in those states from both the individual and employer mandate regimes. As many as 57 million Americans, by one estimate, have now been freed from one of ObamaCare's more onerous burdens. That is a good day's work.
"This ruling is a victory for supporters of limited, accountable government. It's a chance for lawmakers to go back to the drawing board and design true, market-based health reform that is accessible and affordable, and where consumers, not bureaucrats, are in control.
"Within hours, in a separate but similar case, there was a contradictory ruling out of the Richmond, Va.-based 4th Circuit. Nothing is going to change immediately, the federal government has stated intent to seek further review. We hope and look forward to seeing Halbig and other challenges to ObamaCare's lawless implementation at the Supreme Court."
